The first step is to understand the difference between a work visa and a work permit. A work visa is granted by the government at the international airport or customs on arrival in Australia. A work permit, on the other hand, can be applied for from within Australia before travel if it will be applied for outside of one of these two locations. For example, someone applying for a backpacker’s visa in Australia can apply for their permit through an online application process.

The second step is to understand the different types of work permits that exist. There are three types of work permits: general, skilled, and employer-sponsored.

A general work permit is granted to a person who intends to stay in Australia for up to four years; it is valid for any occupation, not just skilled occupations.

A skilled work permit is granted to a person who intends to stay in Australia for up to two years; it allows employment only in chosen occupations on offer through the Australian government’s industry skill shortage list.

An employer-sponsored work permit is granted to an overseas resident who intends to remain in Australia temporarily (up to 12 months) or permanently, and has an offer of employment from a private or public sector entity.

An employer can sponsor a person for any occupation on the industry skill shortage list. General work permits are granted by the Australian Government Department of Home Affairs (DHA). General work permits allow entry into Australia for permanent residence and are not tied to one.

If you have an Australian work visa, you may not need to apply for a work permit.

What do you need to apply for a Work Permit in NSW?

– a completed application for Work Permit (Form 5)

– an approved Work Permit (Form 5A)

– evidence of your qualifications

– evidence of your English language proficiency

– evidence of your suitability for the position

– a letter from an Australian citizen or permanent resident confirming that they are willing to act as an employer sponsor – if required.

Eligibility

You’re eligible to register for work permit NSW if you’re:

  • an authorized worker living in the local government area (LGA) of the concerned area and you are willing to leave your place for work.
  • not form the particular LGA and you have to move outside for work, more than 50km from Greater Sydney.
  • willing to shift permanently to a new residence out of Greater Sydney.
  • juggling between two residencies and if you are traveling to the second house for work purposes, only the worker can travel anytime,
  • for maintenance or any other personal purpose, then only one member of the residence is allowed to travel.
